No sooner did I hit publish then I found this very explanatory write up over the same Clinton-Carter subject.

Actually, moral of the story is: Bush broke the law.
FISA is very explicit about what needs to be done in these circumstances.
For whatever motivation, BushCo decided they didn't feel like securing the appropriate figleaf warrants required to make the operation legitimate.
